Terms and Conditions of buying online

The following are Loaded-pcs online Terms and Conditions of sale to which all online purchases are subject.

1. Price Information

1.1 The prices shown are only applicable to purchases made via the Loaded-pcs website.

1.2 All prices for the Goods are in pounds Sterling and do not include the cost of carriage, packaging or other charges which becomes payable under any contract with Loaded-pcs.

1.3 Prior to the conclusion of the contract Loaded-pcs will inform the customer the total amount to be debited.

1.4 In the unlikely event of an administrative error resulting in an incorrect price being displayed, we reserve the right to correct the price.

1.5 Any change in price will be communicated to the customer at the time of ordering. Prior to the conclusion of the contract Loaded-pcs will inform the customer the total amount to be debited.


2. Ordering goods

Our online store can only accept orders originating from and for delivery to UK addresses. To order goods from our online store simply click the "add to cart" button on the product information page. After making your selections use the "checkout with PayPal link". You will be able to review and amend your order before proceeding through the checkout pages. If you need to amend your order after it has been generated, please contact us via email mail@loaded-pcs.co.uk. Loaded-pcs will confirm receipt of your order by sending an email to you using the address you supplied when registering with our website, however this will not bring into existence a legally binding agreement between us. All orders placed on Loaded-pcs are subject to stock availability and to the validation checks described in section 4 below. Also please refer to section 1 above regarding incorrect prices. No contract will exist between you and Loaded-pcs for the sale of products by us to you until you credit/debit card has been charged. This will be deemed to be our acceptance of your order and to have been effectively communicated to you. Please note that the only language in which the contract can be concluded is English. Details of your order will be retained by Loaded-pcs in our database and these details can be made available on request. Please email us at mail@loaded-pcs.co.uk.


3. Payment

3.1 Payment shall be made by the customer for all monies owed to Loaded-pcs in respect of orders placed for Goods.

3.2 Payment must be made using a PayPal account or a credit/debit card. Payment will be debited to your account before the dispatch of your purchase.


4. Validation Checks

All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.


5. Ownership and Risk

The risk of damage to or loss of goods ordered from Loaded-pcs will pass to the customer when the good are delivered.


6. Delivery of Goods

6.1 Orders can be delivered to addresses within the United Kingdom, however deliveries to non-mainland UK addresses and certain remote locations e.g. Scottish Isles, Isle of Man, Isle of Wight, Northern Ireland, Scottish Highlands, Channel Islands may incur an additional delivery charge and slightly longer delivery lead time. This charge will be shown clearly during the checkout process.

6.2 Goods can be delivered either to your home address, to an alternative address or to your place of work.

6.3 Your delivery will be delivered either by Royal Mail, Royal Mail Recorded Delivery or by a Courier. A signature is required for all Royal Mail Recorded Delivery and Courier delivery.

6.4 If your order contains more than one product the individual products may, on occasions, be sent on multiple despatches and charged for at the appropriate rates.


7. Delivery Charges

When you add products to your shopping cart the appropriate charge will be added automatically. All the delivery charges will be shown clearly throughout the checkout process.


8. Delivery Times

Delivery times are calculated in working days - i.e. Monday to Friday inclusive (working days does not include weekends or the National Bank Holidays). In case of Bank Holidays please allow an extra 2 working days.

From the receipt of the order we will endeavour to deliver your chosen items to you within 12 working days providing the goods are in stock, unless a longer delivery time is stated on the product information page, may take longer.

Deliveries to non-Mainland UK addresses or remote location e.g. Scottish Isles, Isle of Man, Isle of Wight, Northern Ireland, Scottish Highlands, Channel Islands, may take longer.

Any goods delivered by courier should arrive between 9am and 6pm, Monday to Friday. All deliveries must be signed for.

Loaded-pcs will endeavour to meet the delivery time specified in this section, however occasionally delivery times may be affected by factors beyond our control and cannot be guaranteed. We will inform you if we become aware of an unexpected delay.


9. Restrictions on Ordering and Delivery

We can only accept orders from holders of credit or debit cards registered at UK addresses with PayPal accounts.

We can deliver to most addresses in the UK. Unfortunately we are unable to deliver to non-UK destinations, including the Republic of Ireland. Deliveries to British Forces Posted Overseas are restricted by both size and weight.


10. Transit Delays and Non Delivery

10.1 The customer must inspect the Goods as soon as reasonably practicable after delivery and shall within 2 days of such delivery or receipt give notice to mail@loaded-pcs.co.uk of any apparent physical or delivery damage in the goods.

10.2 Queries regarding shortages of goods must be made within 2 days of delivery date to mail@loaded-pcs.co.uk

10.3 Loaded-pcs shall not be liable to compensate the Trade Customer by way of damages or otherwise for non delivery or late delivery of the goods or any of them or for any loss consequential or otherwise arising from the non-delivery or late delivery.

10.4 Conditions 10.1 to 10.3 inclusive do not affect the statutory right of a consumer under the Distance Selling Regulations, Sale of Goods Act 1979, or the Sale and Supply of Goods to Consumer Regulations 2002.


11. Order Cancellations

In the event of a cancellation of part of an order by a Trade Customer Loaded-pcs reserves the right to invoice for any difference in selling price applicable to the quantity despatched up to the time of the cancellation plus a restocking charge. Orders where goods have been specifically ordered for the Trade Customer requirements (schedule and non-stick items) cannot be cancelled.


12. Unwanted Goods

Unwanted goods must be returned within 5 working days to Loaded-pcs. The returned product must be complete, and in 'as new' condition with the original packaging. The customer must take all reasonable care to ensure that all returned items be suitably packaged, and that Goods are protected when being returned. Loaded-pcs reserves the right to levy a handling charge. A charge of 20% of the invoice value of the goods returned, with a minimum charge of £12 will be levied on Goods which are not defective. The customer must bear all the costs of returning any unwanted Goods to Loaded-pcs and provide proof of delivery.


13. Faulty Goods

13.1 Faulty goods under Warranty - Any defects in the Goods which under proper use appear within a reasonable period after delivery and which are due to faulty materials, workmanship or design will be made good by Loaded-pcs either by repair or, at the sole discretion of Loaded-pcs, by replacement or refund. Any claim for Goods or the defective parts should be returned together with proof of purchase and (if relevant), all complete accessories, instruction manuals and software and, wherever possible, in the original packaging. The customer must take all reasonable care ensure that all items be suitably packaged, and that the Goods are protected when being returned. Any claim for defective Goods or parts must be made in writing (specifying the date of purchase and invoice number) within a reasonable period of time after delivery.

13.2 All warranties and conditions which are capable of being excluded by statute or otherwise are excluded from any contract provided that nothing in the contract shall affect the statutory rights of the Consumer or liability for death or personal injury causes by the negligence of Loaded-pcs.

13.3 Loaded-pcs reserve the right to inspect any Goods returned prior to issuing credit for those Goods.

13.4 Warranty seals applied to any Goods supplied by Loaded-pcs must not be removed or broken and any product without the warranty seals intact will be deemed to have had any warranty invalidated and the Goods will be deemed to have been accepted by the customer.

13.5 Conditions 13.1 to 13.4 inclusive do not affect the statutory rights of a Consumer under the Consumer Protection (Distance Selling) Regulations 2000 or any statutory modification thereof.


14. Data Protection

14.1 By placing an order with Loaded-pcs the customer agrees to data relating to the transaction being retained and processed by Loaded-pcs in accordance with the Data Protection Act 1998 or the statutory modification thereof. The data so retained will be used by Loaded-pcs for the purpose of accounting and marketing and will not be disclosed to any third party without the previous consent in writing of the consumer.

14.2 Loaded-pcs may send to the customer details of other Goods and the services offered by Loaded-pcs may consider to be of interest to the customer. If the Customer does not wish to receive details of these offers then they contact Loaded-pcs in writing at mail@loaded-pcs.co.uk requesting that data is removed from the marketing database. The Customer may, by writing to mail@loaded-pcs.co.uk request that all data relating to him, her or it should be deleted from its records. Customers may also, in accordance with the provisions of the Data Protection Act 1998, obtain copies of such data that is held in respect of them by Loaded-pcs.


15. Limitation of Liability

15.1 The customer will be responsible for ensuring the fitness for purpose of the Goods for the customer's application unless the purpose is previously notified to Loaded-pcs.

15.2 To the extent permitted by law, Loaded-pcs accepts no liability whatsoever or howsoever arising in respect of loss, damage or expense arising from errors in information or advice provided whether or not due to Loaded-pcs negligence or that of its employees, agents or sub-contractors save for any loss or damage arising from death or personal injury.

15.3 To the extent permitted by law, Loaded-pcs shall not be liable to the Customer by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of any Contract with the Customer, for any indirect, special or consequential loss or damage (whether for the loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of Loaded-pcs, its employees or agents or otherwise) which arise out of or in connection with the supply of the Goods or their use or resale by the Customer.

15.4 The entire liability of Loaded-pcs under or in connection with the Contract with the Customer shall not exceed the price of the Goods except as expressly provided in these terms and conditions.


16. Force Majeure

Loaded-pcs shall not be liable to the Customer or deemed to be in breach of Contract by reason of any delay in performing, or any failure to perform, any obligations of Loaded-pcs in relation to the Goods, provided that the delay or failure was due to any cause beyond reasonable control of Loaded-pcs. Without prejudice to the generality of the forgoing, the following shall be regarded as causes beyond reasonable control of Loaded-pcs : Act of God, explosion, flood, tempest, fire or accident; war or threat of war, sabotage, insurrection, civil disturbance or requisition; acts, restrictions, regulations bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority; import or export regulations or embargoes; strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of Loaded-pcs or of the third party); difficulties in obtaining raw materials, labour, fuel, parts or machinery; power failure or breakdown in machinery or any other contingency whatsoever beyond seller's control, to be sufficient excuse for any delay or non-fulfilment traceable to any of these causes.


17. Law

All contracts between Loaded-pcs and the Customer shall be governed by and interpreted in accordance with the English Law and both Loaded-pcs and the Customer submits to the exclusive jurisdiction of any competent Court in the United Kingdom.


18. Consumer Protection

Nothing contained herein shall affect a Consumer's rights under the Unfair Contract terms Act 1977 or the regulation made under it including the Unfair Terms in Consumer Contracts Regulations 1994.

Loaded-pcs makes no representation that any product referred to in the materials on this website are appropiate for use, or available, in other locations. Those who choose to access this website from other locations are responsible for compliance with local laws if and to the extent local laws are applicable.
